These Terms of Use ("Terms") govern your access to and use of SpeakLink (the "App"), provided by SpeakLink/ESLAN Services ("we", "us", or "our"). By accessing or using the App, you agree to these Terms.

1. Eligibility

You must be able to form a legally binding contract in your jurisdiction to use the App. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Accounts and access

• You are responsible for maintaining the confidentiality of your account and for all activity under your account.
• You must provide accurate information and keep it up to date.
• We may suspend or terminate access if we reasonably believe your account is being used unlawfully or in breach of these Terms.

3. Subscription and paid features

SpeakLink may offer paid membership features. Pricing, billing period, and included features are shown in the App at the point of purchase. Membership benefits may change over time as the App evolves.

4. Acceptable use

You agree not to:

• Use the App for unlawful, harmful, or abusive purposes.
• Attempt to reverse engineer, exploit, or disrupt the App or its infrastructure.
• Upload or submit content that infringes intellectual property rights, violates privacy, or is offensive or discriminatory.
• Circumvent access controls or paid feature gating.

5. Educational nature; no guarantees

SpeakLink provides language practice and feedback tools for educational purposes only. We do not guarantee specific outcomes, scores, or improvements.

6. Audio, scoring, and AI services

The App may use third-party services to generate audio and provide pronunciation scoring/feedback. Results can vary and may not be error-free. You are responsible for how you interpret and use any feedback.

7. Intellectual property

The App, its design, branding, and all related materials are owned by us or our licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, or distribute the App or its content except as permitted by law or with our prior written permission.

8. User content

If the App allows you to submit content (including recordings), you retain ownership of your content. You grant us a limited license to host, store, process, and display that content solely to operate and improve the App and to provide the requested functionality.

9. Third-party links

The App may link to third-party websites or services. We are not responsible for third-party content, policies, or practices.

10. Disclaimer

To the maximum extent permitted by law, the App is provided "as is" and "as available" without warranties of any kind, whether express or implied.

11. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the App.

12. Changes to the App and Terms

We may update the App and these Terms from time to time. If changes are material, we will update the "Last updated" date. Continued use of the App after changes means you accept the updated Terms.
